Terms and Conditions

Please read these terms and conditions carefully before using Our Service.

The Service Terms and Agreements for Transportation Reservations (the “Agreement”) is by and between SWIVL Rides LLC and you (either individually or on behalf of any entity whom you are representing) (“client” or “you”).

1. Services Provided

SWIVL Rides provides services through a network of drivers, vehicles, and related platforms, including our website. We offer various types of rides, including but not limited to one-time bookings, scheduled rides, and other special services as provided on our platform.

2. Eligibility

To use our service, you must:

  • Be at least 18 years old.
  • Provide accurate, complete, and current information when booking a ride
  • Be legally able to enter into a contract.

By using our service, you represent and warrant that you meet these eligibility requirements.

3. Booking and payment

  • Booking: You can book rides on our website or by calling/texting us at 512-786-6678. By confirming a ride request, you enter into a contract with us and agree to the terms set out herein.

  • Payment: Payment for services is due at the time of booking unless otherwise agreed. We accept various payment methods, including debit/credit cards and electronic payment platforms. All payment transactions are subject to our payment provider’s terms and conditions.

  • Cancellations and Refunds: Cancellations must be made 12 hours before your ride. If you cancel after this period, you may be charged a cancellation fee (20% of the quoted fare). If you cancel your booking less than 3 hours before your scheduled pickup or are a no-show the full quoted fare will be charged. Refunds if applicable, will be provided in accordance with our refund policy.

  • Intercity Bookings: A 50% deposit is required before booking. The other 50% will be collected at the time of pick up unless otherwise agreed.

4. Passenger Conduct

  • You agree to conduct yourself respectfully and courteously toward the driver and other passengers.
  • Alcohol, drugs, and other illegal substances are strictly prohibited in our vehicles.
  • Smoking is prohibited in our vehicles.
  • You are responsible for any damage caused to the vehicle during your ride. You agree to compensate us for any such damage.

5. Drivers and Vehicle Standards

  • Drivers: We ensure that our drivers meet our safety standards, including background checks and licensing.
  • Vehicles: Our vehicles are regularly maintained for safety and comfort. We reserve the right to substitute the vehicle type if necessary.

6. Liability and Disclaimers

  • Limitation of liability: To the maximum extent permitted by law, SWIVL Rides is not liable for any loss, injury, or damage resulting from the use of our services. Our liability is limited to the amount paid for the specific service, excluding any indirect, incidental, or consequential damages.

  • Delays – We are not liable for delays or failures to perform caused by events outside of our control, including but not limited to weather, natural disasters, traffic, accidents, or technical issues.

  • No guarantees of availability: We make no guarantees that our services will be available at all times.

7. Intellectual property

All content, features, and functionality on our website and other platforms including text, graphics, and logos are the property of SWIVL Rides, we are protected by intellectual property laws. You may not use, copy, or distribute any part of our content without express permission.

8. Amendments and Terminations

We reserve the right to modify or update these Terms at any time, with or without notice. Any changes will be effective immediately upon posting on our website. We encourage you to review these terms periodically.

We may suspend or terminate your access to our services if you violate these terms or engage in behavior that is harmful to us, our drivers, and other passengers.

9. Indemnification

You agree to indemnify and hold harmless SWIVL Rides, its employees, contractors, and agents from any claims, damages, liabilities, or other expenses arising from your use of our service, including but not limited to your breach of these Terms, your conduct, or your interactions with other passengers or drivers.
